These Terms of Use ("Terms") govern your access to and use of the websites leadwithlistening.com and courses.leadwithlistening.com, the Listening Audit, The Listening Advantage course, the Premium Report, coaching and related programs, and any other content, products, or services we provide (collectively, the "Services"), offered by Tindall Avenue Events & Entertainment, LLC, doing business as Lead with Listening ("Lead with Listening," "we," "us," or "our").
By accessing or using the Services, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, do not use the Services.
1. Eligibility

2. The Services
Lead with Listening provides educational and professional-development content and tools focused on leadership and listening skills, including the HEARD framework, assessments, video courses, downloadable materials, and coaching. We may add, modify, or discontinue features or offerings at any time.
3. Accounts
Certain Services require an account. You agree to provide accurate information, keep your login credentials confidential, and remain responsible for all activity under your account. Notify us promptly of any unauthorized use.
4. Purchases, pricing, and payment
- Prices for products and services are listed at the point of sale and are subject to change. The price that applies to your purchase is the price displayed at checkout.
- Payments are processed by our third-party payment processor (Stripe). By purchasing, you authorize us and our processor to charge your selected payment method for the amount shown, including any applicable taxes.
- If a payment plan is offered and selected, you authorize the scheduled installment charges described at checkout, and you remain responsible for completing all installments.
- Access to a purchased product is granted after payment is received.
5. Refunds and cancellations

To help you decide before you buy, we offer free ways to experience the Services first — including the free Listening Audit and a free preview of Module 1. Because our digital products provide immediate access to downloadable and streamable content, all sales are final and purchases are non-refundable, except where a refund is required by applicable law or expressly stated in writing at the point of sale. 6. License and intellectual property
- Our content. All content provided through the Services — including the HEARD framework, the Listening Audit, course videos, slides, workbooks, cheat-sheets, text, graphics, logos, and other materials — is owned by or licensed to Lead with Listening and is protected by intellectual property laws.
- Your license. Upon purchase, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to access and use the purchased content for your own individual, non-commercial learning. Lifetime access, where offered, means for the lifetime of the product and the platform on which it is hosted, and is subject to these Terms.
- Restrictions. You may not copy, reproduce, republish, distribute, sell, license, share your account or access credentials, publicly display, or create derivative works from our content, except as expressly permitted. You may not use our content to build a competing product or service. Trademarks, including "Lead with Listening" and "HEARD," may not be used without our prior written permission.
7. Acceptable use
You agree not to: (a) use the Services for any unlawful purpose; (b) attempt to gain unauthorized access to the Services or related systems; (c) interfere with or disrupt the Services; (d) upload malicious code; (e) scrape, harvest, or collect information about other users; or (f) infringe the rights of others. We may suspend or terminate access for violations.
8. Educational purpose; no professional advice
The Services provide educational and professional-development content and are for informational purposes only. They are not a substitute for professional, legal, financial, medical, or mental-health advice, diagnosis, or treatment, and no coach-client, therapist-client, or other professional relationship is created by your use of the content unless we separately agree in writing to a coaching engagement. Always seek the advice of a qualified professional for your specific situation.
9. No guarantee of results
We are committed to providing high-quality content, but individual results depend on many factors within your control. We do not guarantee any specific outcome, result, or level of improvement from using the Services.
10. Coaching services
Where you engage us for one-on-one or team coaching, additional terms provided at the time of engagement (such as a coaching agreement or statement of work) will apply and, in the event of a conflict, will govern that engagement.
11. Third-party services and links
The Services rely on and may link to third-party platforms and websites (including those listed in our Privacy Policy). We are not responsible for the content, policies, or practices of third parties, and your use of their services is governed by their terms.
12. Disclaimers
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
13. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, LEAD WITH LISTENING AND ITS OWNERS, EMPLOYEES, AND CONTRACTORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICES. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICES WILL NOT EXCEED THE AMOUNT YOU PAID US FOR THE SERVICES GIVING RISE TO THE CLAIM IN THE [12] MONTHS BEFORE THE CLAIM. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
14. Indemnification
You agree to indemnify and hold harmless Lead with Listening and its owners, employees, and contractors from any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising from your use of the Services or your violation of these Terms.
15. Termination
We may suspend or terminate your access to the Services at any time for any violation of these Terms or for conduct that we reasonably believe harms the Services or other users. Provisions that by their nature should survive termination will survive.
16. Governing law and dispute resolution
